This Privacy Policy explains how Hayley Sheppard (referred to as we, us, or our) collects, uses, stores, and shares personal information.

We operate from Australia and may work with clients worldwide through coaching, programs (including Rooted & Rising), speaking, and collaborations.

We aim to comply with Australia’s Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs). Where relevant, we also consider privacy requirements in other regions, including the GDPR and UK GDPR, CCPA/CPRA, PIPEDA, NZ Privacy Act 2020, and South Africa POPIA.

2) What Information We Collect

We collect personal information that is reasonably necessary to run our business, deliver services, and communicate with you.

Data categories we may collect

  • Identity and contact details: name, email address, phone number, location (city/state/country), and other details you provide.

  • Billing and transaction information: invoices, purchase history, payment status, refunds, and limited payment details (such as payment method type and last four digits, depending on the provider).

    • Payments are processed by Stripe and PayPal. We do not store full card numbers.

  • Booking and appointment information: appointment date/time, time zone, attendance, and scheduling preferences.

  • Communications: emails, messages, SMS (where used), support requests, and notes relating to your enquiries or participation.

  • Coaching and intake information: information you provide in forms, questionnaires, applications, surveys, worksheets, or during coaching (for example goals, challenges, and personal context).

    • Please avoid sharing sensitive health or medical information unless we specifically request it and it is needed to provide the service.

  • Program delivery information: attendance, progress, completion, and participation in online sessions, communities, or learning platforms (if used).

  • Technical and usage information: IP address, device type, browser type, pages visited, referral URLs, and interactions with our emails and web pages (for example opens and clicks). This may be collected via cookies and similar technologies.

3) Sensitive Information

We do not intentionally collect sensitive information (such as health information, biometric data, or information about racial or ethnic origin, political opinions, religious beliefs, or sexual orientation).

Because coaching can involve personal topics, you may choose to share information that could be sensitive. We ask you not to provide sensitive health or medical details unless we request it and it is necessary for service delivery. If we ever need sensitive information, we will handle it with extra care and, where required, seek your consent or rely on another lawful basis.

4) How We Collect Information

We collect personal information in several ways:

  • Directly from you, when you:

    • complete forms, sign up to a waitlist, download resources, apply for programs, complete questionnaires, or submit surveys

    • book appointments or consult calls

    • purchase a product or program

    • contact us by email, social media, phone, or video call

    • participate in coaching sessions, groups, or events

  • Automatically, when you use our website, emails, or online services:

    • through cookies and similar technologies

    • through analytics and measurement tools

  • Through service providers, when they process information on our behalf.

GoHighLevel (GHL)

We use GoHighLevel (GHL) for CRM and business operations such as:

  • forms and funnels (including landing pages)

  • contact management (CRM records and notes)

  • email marketing and automations

  • scheduling and appointment management (if enabled)

  • pipeline management and automations

We plan to use SMS and two-way messaging/chat in the future. If and when enabled, messages and related conversation history may be stored and processed within GHL and/or our SMS delivery providers.

5) How We Use Information

We may use your information for:

  • Service delivery: providing coaching, programs, resources, speaking, and collaborations.

  • Administration: onboarding, record-keeping, and responding to enquiries.

  • Appointments: booking confirmations, reminders, rescheduling, and follow-ups.

  • Payments and accounting: processing purchases, invoices, refunds, and chargebacks.

  • Marketing communications: sending newsletters, updates, and offers (email now, and SMS in the future where you opt in).

  • Improving our services: analysing feedback, website performance, and campaign effectiveness.

  • Security and fraud prevention: protecting our business, systems, clients, and community spaces.

  • Legal and compliance: meeting legal obligations, resolving disputes, and enforcing agreements.

6) Legal Bases for Processing (GDPR and UK GDPR)

If you are in the UK/EEA (or where your local law requires it), we process personal data using these lawful bases:

  • Consent: for marketing sign-ups, SMS (when used), and non-essential cookies where required.

  • Contract: to deliver services you request, manage bookings, and process payments.

  • Legitimate interests: to operate and improve our business, secure our systems, measure performance, and communicate with existing clients about relevant service updates. We balance this against your rights.

  • Legal obligation: where we must keep records or respond to lawful requests.

You can withdraw consent at any time. This does not affect processing that already occurred.

7) Marketing Communications (Email and SMS via GHL)

  • Email marketing: You can unsubscribe at any time using the link in our emails, or by emailing [email protected].

  • SMS marketing (future): If we offer SMS updates and you opt in, you will be able to opt out by replying STOP or using the instructions in the message.

We may still send service messages that are not marketing, such as booking reminders, receipts, and important program notices.

8) Cookies and Tracking

Cookies are small files stored on your device that help websites function and provide analytics and measurement.

We use cookies and similar technologies for:

  • Essential website functions (where required for basic functionality and security)

  • Analytics: Google Analytics helps us understand website traffic and improve performance

  • Measurement tags: Meta Pixel and LinkedIn tags may help us understand website interactions and the effectiveness of our marketing content

No current ads: We are not currently running paid ads. Even so, measurement tags may still collect or receive limited data (for example page visit events), depending on your browser and settings.

9) Sharing and Disclosure of Information

We may share personal information:

  • With service providers who help us run our business. This may include:

    • GoHighLevel (GHL) (CRM, forms/funnels, email, automations, scheduling if enabled)

    • Stripe and PayPal (payments processing)

    • Google Analytics (website analytics)

    • Meta Pixel and LinkedIn tags (website measurement)

    • Google Drive (cloud storage)

    • Zoom (video calls, and recordings, transcripts, or summaries where enabled)

  • For legal reasons if required by law, court order, or to respond to lawful requests, and to protect rights, safety, and security.

  • As part of a business transfer such as a restructure, merger, or sale, where personal information may be transferred.

We expect service providers to handle personal information in a way that supports appropriate privacy and security obligations for their role.

10) Recordings, Transcripts, and AI-Generated Summaries (Zoom)

We may record online sessions, including group program sessions and 1:1 sessions, by default. We do this for service delivery, quality, and replay access.

  • Recordings may include your name, image, voice, and chat contributions if you participate with camera, microphone, or chat enabled.

  • We will tell you before recording starts. If you do not want to be recorded, tell us before the session begins so we can discuss options.

  • Zoom AI features: Zoom may provide AI-enabled features (such as transcripts, summaries, highlights, or action items). If these features are enabled, Zoom may process meeting content to generate those outputs.

  • Replay access: Recordings are generally available for the life of the program cohort (while that cohort’s access to program materials remains available). We may remove or archive recordings when they are no longer needed, or if required for legal, safety, or platform reasons.

11) We Do Not Sell Personal Information (CCPA/CPRA Note)

We do not sell personal information in the ordinary sense.

If you are in California, the CCPA/CPRA also uses the term “share” to cover some types of targeted advertising activity, such as cookie-based identifiers used for cross-context behavioural advertising. Although we are not currently running paid ads, measurement tags may still operate.

If applicable, you may have the right to opt out of “sale” or “sharing”. You can request this by emailing [email protected] with the subject line: Do Not Sell or Share My Personal Information, or by using controls available at www.hayleysheppard.com/cookies (where applicable).

12) Data Retention

We keep personal information only as long as needed for the purposes in this Policy, unless a longer period is required by law.

Default retention settings:

  • Client coaching records (including intake forms and session notes): 7 years after last interaction.

  • Marketing subscriber details: until you unsubscribe. After unsubscribing, we keep a minimal suppression record (to ensure we do not message you again) for up to 7 years.

  • Appointment records: 24 months after the appointment date.

  • Financial and tax records: at least 5 years (or longer if required).

13) Security Measures

We take reasonable steps to protect personal information from misuse, interference, loss, unauthorised access, modification, or disclosure. This includes access controls, reputable providers, and appropriate security practices.

No method of transmission or storage is 100% secure, so we cannot guarantee absolute security.

14) International Transfers

We operate online and use third-party providers. Your personal information may be processed or stored outside Australia, including in countries where our service providers operate.

Where required (including under GDPR/UK GDPR), we use appropriate safeguards for international transfers, such as contractual protections and other lawful transfer mechanisms.

15) Your Rights

Your rights depend on where you live. We try to honour privacy rights in a consistent, practical way.

Australia (Privacy Act and APPs)

You can request access to, or correction of, the personal information we hold about you. You can also make a privacy complaint (see “Contact and Complaints”).

GDPR and UK GDPR

You may have rights to access, correct, delete, restrict, object, data portability, and withdraw consent (where applicable), and to complain to a regulator.

CCPA/CPRA (California)

You may have rights to know, access, delete (with exceptions), correct, opt out of sale or sharing (if applicable), and not be discriminated against for exercising rights.

PIPEDA (Canada), NZ Privacy Act 2020, POPIA (South Africa)

You may have rights to access and correct your personal information, and additional rights depending on the law and circumstances.

How to exercise your rights

Email [email protected] and include:

  • your name and preferred contact details

  • what you are requesting

  • enough information for us to verify your identity and locate your information

We may ask for identity verification to protect your privacy. We will respond within a reasonable timeframe and within legal timeframes where they apply.

16) Children’s Privacy

Our services are not directed to children under 16. We do not knowingly collect personal information from children under 16. If you believe a child has provided personal information, contact us at [email protected] and we will take steps to delete it.

17) Third-Party Links

Our website and communications may contain links to third-party websites or services. We are not responsible for their privacy practices. Please review their privacy policies before providing personal information.

18) Updates to This Policy

We may update this Privacy Policy from time to time. The latest version will be posted on our website with an updated “Last updated” date. If changes are significant, we may notify you in a reasonable way (for example, by email or a website notice).
